Samsung is Another Step Closer to an Apple Design Patent Damages Retrial

Judge Lucy Koh of the United States District Court for the Northern District of California, who has been presiding over Apple v. Samsung since the beginning, entered an order Friday evening local time that could very well (but won't necessarily) lead to another Apple-Samsung retrial, according to a new FOSS Patents report.


The court document that is presented in full below starts by stating the following: "After two jury trials and decisions by both the Federal Circuit and the United States Supreme Court, the instant case has been remanded for a determination of whether a new trial on the $399 million award for design patent damages is required."
