Apple files for Three Trademarks Protecting the iPhone Design

On July 2, 2014, the US Patent & Trademark Office published three of Apple's latest trademark filings which are set out to protect the iPhone's latest hardware and Home Page designs. Apple's iPhone design played an important role in Apple's battle against Samsung over the years. The updated designs now appear to cover the iPhone's larger Home Button, which reflects their new Touch ID feature, and iOS 7's flatter UI with redesigned icons. As you'll note in our report, Apple's descriptions of the new iPhone designs are quite extensive.

 

Apple's First iPhone Design

 

2AF. APPLE IPHONE DESIGN WITH HOME PAGE IN COLOR 2 - 86322587

In the description of Apple's First iPhone design filed under number 86322587, they state that "The mark consists of the configuration of a rectangular handheld mobile digital electronic device with rounded black edges, a black face, and an array of twenty-two icons consisting of squares with rounded edges arranged in six rows on the face of the screen."

 

The rest of Apple's trademark application verbiage applies to only their first and second designs trademark applications as follows:

 

"In the first row, the first icon consists of a square with rounded corners that is shaded from light green at its top to darker green at its bottom and in which appears a white stylized speech bubble; the second icon consists of a white square with rounded edges in which appears the number one; the third icon consists of a white square with rounded edges in which appear red, orange, yellow, green, blue, purple, and pink elongated ovals overlaying each other in a manner that creates the visual of effect of three-dimensional depth with a white circle in the center; and the fourth icon consists of a square with rounded corners that is shaded from light gray at its top to darker gray at its bottom and in which appears an outline of a black camera against a dark gray background with a large gray circle depicting a lens and a small yellow circle to the upper right. In the second row, the fifth icon consists of a square with rounded corners that is shaded from dark blue at its top to lighter blue at its bottom and in which appear a yellow sun behind a white cloud; the sixth icon consists of a black square with rounded corners in which appears a clock with a white face, black numbers, black minute and hour hands, and a red second hand; the seventh icon consists of a square with rounded corners in which appears an image of an abstracted map with streets in white, a highway in yellow, a highway sign in blue, white and red bearing the number "280" in white, and a blue line with a white arrow inside of a blue circle; and the eighth icon consists of a square with rounded corners that is shaded from light blue at its top to darker blue at its bottom and in which appears a stylized director's clapper with black and white chevrons on the top quarter. In the third row, the ninth icon consists of a square with rounded corners depicting stylized notebook paper with a yellow top border and gray lines appearing on white paper; the tenth icon consists of a white square with rounded corners in which appear five gray horizontal lines and an orange circle, a blue circle, a green circle, and a purple circle on the left-hand side; the eleventh icon consists of a black square with rounded corners with an image of a white graph, light gray vertical stripes across the square, and one blue vertical line with a blue dot on it; the twelfth icon consists of a white square with rounded edges in which appear a blue sphere, a yellow sphere, a red and pink sphere, and a purple sphere, all of different sizes, and all overlaying each other to give the visual effect of three-dimensional depth; in the fourth row, the thirteenth icon consists of a light gray square with rounded corners in which appear a yellow magazine with visual geometric shapes of a red square, a blue circle, a white triangle, and a brown horizontal bar at the top, a gray newspaper with a black outline of a stylized globe in the center and two sets of horizontal black lines on either side, a blue magazine containing the image of a white airplane in the center with six dark blue lines at the top, and a green magazine containing the image of part of a tennis court outlined in white with a yellow tennis ball in the center and a light green horizontal bar at the top; the fourteenth icon consists of a purple and pink square with rounded corners with a white stylized musical note in the center surrounded by a white circle; the fifteenth icon consists of a square with rounded corners that is shaded light blue at its top to darker blue at its bottom and in which appear a white circle surrounding a white letter "A" composed of a ruler, a pencil, and a paintbrush; and the sixteenth icon consists of a square with rounded edges consisting of a blue stripe on top with a white silhouette of an airplane, a green stripe in the middle with a white silhouette of a video camera, and an orange strip on the bottom with a white silhouette of a tea cup. in the fifth row, the seventeenth icon consists of a black square with rounded corners on which appears a white four-point compass with the letters clockwise "N," "E," "S," and "W" on a black background and with a gray plus inside of a circle in the center, a red triangle at North, and white tick marks for degrees; the eighteenth icon consists of a square with rounded corners depicting two concentric circles with jagged edges evoking the image of gears, all in varying shades of gray. In the sixth row, the nineteenth icon consists of a square with rounded corners shaded from light green at its top to darker green at its bottom and in which appears a stylized white telephone receiver; the twentieth icon consists of a rectangle with rounded corners that is shaded from dark blue at its top to lighter blue at its bottom and in which appears a stylized white envelope with blue lines; the twenty-first icon consists of a white square with rounded corners in which appears a stylized compass composed of a blue and light blue circle, white degree marks, and a stylized needle with white on the bottom half and red on the top half; and the twenty-second icon consists of a red, orange, and pink square with rounded corners with a white stylized design of a musical note in the center. The matter shown in broken lines is not part of the mark."

 

Apple filed all three iPhone trademark applications under the same International Class 009 which carries the following verbiage/coverage: Handheld mobile digital electronic devices consisting of a mobile phone, digital audio and video player, handheld computer, personal digital assistant, electronic personal organizer, electronic notepad, electronic calendar, electronic book reader, calculator, and camera, and capable of providing access to the Internet and sending and receiving electronic mail, digital audio, video, text, images, graphics and multimedia files.

 

Apple's Second iPhone Design

 

3AF. APPLE IPHONE HOMEPAGE UI DESIGN 86322593

In the description of Apple's second design filed under number 86322593 they state that "The mark consists of an array of twenty-two icons consisting of squares with rounded edges arranged in six rows." The rest of the description verbiage mirrors that of the first design as indicated above.

 

Apple's Third iPhone Design

 

4AF.  Apple B-W - IPHONE DESIGN WITH ICONS - 86322577

The description for Apple's third design filed under number 86322577 differs from the first two. It simply covers the following: "The mark consists of the configuration of a rectangular handheld mobile digital electronic device with rounded edges and an arrangement of twenty-two icons consisting of squares with rounded edges arranged in six rows on the screen of the device. The matter shown in broken lines is not part of the mark."

 

Although the trademark applications were officially published today, they were in fact filed for on June 27, 2014.
