The 'Apple Vision Pro' trademark filed in China has been refused, complicating the Headset's Launch in China

Back in June 23, 2023, Patently Apple posted a report titled "Oops! Huawei filed for the "Vision Pro" Trademark in China back in 2019 which will likely force Apple to rebrand their Headset." Below is a copy of the trademark application from Huawei for 'Vision Pro.'

When I clicked on the trademark's "details" link it noted that trademark was covered for Wearable computers, Smart Glasses; Head-Mounted Virtual Reality Devices; Wearable video displays.  This is in direct conflict with Apple's trademark application in China.

Today we're learning from a South China Morning Post report that the Chinese National Intellectual Property Administration (CNIPA), that Apple's application for the trademark rights to "Vision Pro" is currently in a state of "refusal to re-examine."

Patently Apple posted a separate trademark report back in June 23, 2023 covering Apple's trademark application for the figurative version of Apple Vision Pro in both Hong Kong and Europe.

While their trademark Class definitions are too lengthy to present in full, the trademark was filed under classes 09, 38 and 42. Class 09 generally covers all manor of hardware including head-mounted displays, smartglasses, VR headsets, AR headsets, biometric ID and more; Class 38 generally covers  Transmission of voice, data, images, music, audio, video, television, movies, radio, podcasts, games, and other multimedia by means of telecommunications networks, computer networks, the Internet, wireless communications networks; streaming of data; transmission of digital files; providing access to telecommunications networks, computer networks, the Internet; communication by computers; providing telecommunications connections to a global computer network, FaceTime conferencing and more; and Class 42 generally covers Design and development of computer hardware, software, and peripherals; design and development of virtual and augmented reality hardware, software and peripherals; consultancy in the design and development of computer hardware and peripherals; design and development of computer game software and virtual and augmented reality software; content creation for virtual worlds and three dimensional platforms and more.

At this stage, there's no reason to believe that Huawei will give up their trademark for the sake of conveniencing Apple. Though as the saying goes: Never say never. While an obscene amount of money and back-room politics could always lead to a deal – I just can't see Huawei appeasing their archrival.
