Apple has filed for six new Figurative trademarks covering the 'Head Measurement and Fit' Icon for Apple Vision Pro, M3, M3 Pro, M3 Max & more
This week, Apple filed three new Figurative Trademarks, meaning, trademarks that are visual in nature without text. The first covers "Head Measurement and Fit" relating to Vision Pro, another for Apple's new "Journal" App and the third for "Logic Remote."
Figurative Trademark for 'Head Measurement and Fit'
In the video below, Mike Rockwell, VP of the Apple's Technology Development Group stated at one point during his introduction of Apple Vision Pro's technologies that "Using our most advanced machine learning techniques, we created a novel solution. After a quick enrollment process using the front sensors on Vision Pro, the system uses an advanced encoder-decoder neural network to create your digital persona."
Apple filed their figurative trademark under International Class 09 which covers "downloadable software for facial scanning and measurement; downloadable software for fitting wearable computer hardware to the user."

The U.S. Patent Office defines a specimen as being an example of how a company is actually using their trademark in the marketplace with the goods or services in their application. It's what consumers see when they are considering whether to purchase goods or subscribe to services that Apple provides in connection with their trademark.
For Apple's "Head Measurement and Fit" icon, Apple provided the U.S. Patent and Trademark Office with 3 panels as presented below illustrating how it will be used in public.

Apple also filed this trademark in Hong Kong under application #306390126.
Apple's Figurative Trademark for the "Journal" App
With iPhone 15, the new "Journal App" came with iOS 17. For those with older iPhones, you require iOS 17.2 in order to download the app from the app store, according to the App Store. Whether the Journal app will simply appear once iOS 17.2 is downloaded is unknown at this time.
Apple filed for this figurative icon trademark last week even though it only appeared in USPTO's database this week under application #9824409.
Apple filed their new trademark in the U.S. under International Class 009 covering "Downloadable and recorded computer software for creating, capturing, recording, editing, modifying, storing, displaying and viewing personal journals, diaries, photos, images, graphics, documents, data, videos, audio, and multimedia content; downloadable and recorded computer software for keeping a multimedia diary or personal journal; downloadable and recorded intelligent personal assistant software for providing reminders, notifications and curated suggestions for writing a diary or personal journal."
Apple also filed for this trademark in Hong Kong under application #306383926. In addition to International Class 09 as outlined above, Apple added International Class 042 in Hong Kong covering "Providing online non-downloadable software; software as a service (SaaS) for non-downloadable software for creating, viewing, displaying, editing, annotating, storing, and organizing photos, images, graphics, documents, presentations, data, videos, and multimedia content; Software as a service (SaaS) for non-downloadable software for word processing; cloud computing services; cloud computing featuring software for keeping a diary and tracking mood and for word processing; cloud computing featuring software for creating, viewing, displaying, editing, annotating, storing, and organizing photos, images, graphics, documents, presentations, data, videos, and multimedia content."
Figurative Trademark Filing for "Logic Remote" Music
Apple filed for the figurative trademark for "Logic Remote" under application #98240606. They filed it under International Class 009 covering "Computer software for digital audio production, processing, and editing."

Three Apple M3 Processor Related Figurative Trademarks
Apple filed for figurative versions of their M3 Processor family in Europe on October 31, as presented below:
All three figurative trademarks for the M3 family were filed in Brussels (Belgium) under International Class 09 covering "System-on-chips; computer chips; integrated circuits."
It should be noted that international trademark classes that Apple files their trademarks under are important as the trademark registration will only protect those classes that have been identified in their original application. In a legal battle, the classes filed for originally could make or break a legal case.
