While the Dutch Antitrust Authority continues to hit Apple with €5 Million fines per week, a new Multibillion-Euro Class Action has now been filed
It's being reported today that Apple Inc. has been targeted by a Dutch class action lawsuit claiming multibillion-euro damages as the iPhone maker’s legal battles over apps and in-app purchases continue to mount.
The Consumer Competition Claims Foundation stated in a press release today that Apple "has taken advantage of its monopoly position" with its 30% fee for every sale from app developers, forcing them to increase their prices. The foundation claims the potential harm could add up to nearly 5 billion euros ($5.5 billion).
The Dutch case comes on the heels of the nation’s antitrust authority fining Apple 50 million euros for rule-breaking in a dispute over payment systems for dating applications.
The Authority for Consumers & Markets stated in a press release on Monday that it is reviewing Cupertino, California-based Apple’s new proposal to fully comply with an order to offer payments outside the app store to dating app providers. For more, read the full Bloomberg report.
Last week we reported that "Apple legal urged a federal appeals court to uphold a judge’s ruling that largely vindicated its business model which charges commissions on developers for App Store transactions.
last Thursday Apple legal argued that Epic Games Inc., the maker of Fortnite, had failed to provide evidence backing its claim that Apple’s app distribution marketplace is a monopoly."
This is a key point in Apple's legal strategy, to force those claiming that Apple has a monopoly on apps to prove such a claim. Apple is likely to argue the same thing in the the Netherlands case.
