Epic Games asked the court on Friday to basically overrule Judge Rogers and Force Apple to be Reinstate their company in the App Store
On August 25 Patently Apple posted a report titled "U.S. District Judge Temporarily Splits the Rulings in the Apple-Epic Games Battle over the App Store and Unreal Engine." U.S. District Judge Yvonne Gonzalez Rogers provided a temporary judgement that Apple wouldn't have to reinstate Epic Games Fortnite on its App Store until there's a final judgement.
Apparently Epic Games CEO wasn't happy with that ruling and went back to court on Friday seeking a preliminary injunction that would put its game back in the App Store and restore its developer account. The filing was made in the United States District Court for the Northern District of California.
It argued that Epic Games is "likely to suffer irreparable harm" in the absence of a preliminary injunction and that "the balance of harms tips sharply in Epic’s favor."
The filing described the iPhone maker as a "monopolist" that maintains its monopolies by "explicitly prohibiting any competitive entry."
Epic's filing added that "This was a clear warning to any other developer that would dare challenge Apple’s monopolies: follow our rules or we will cut you off from a billion iOS consumers - challenge us and we will destroy your business." For more read the full Reuters report.
You have to wonder if Representative David Cicilline, the Democrat leading the high-profile investigation into technology giants has promised Epic Games CEO that Apple would be labelled a monopolist and forced to make major changes to the App Store or even worse.
Epic's CEO Tim Sweeney is basically saying that the ruling by Judge Rogers in Apple's favor, locking Epic Games out of the App Store, won't stand and so he'll just get another judge to rule in his favor as if he's privileged.
Sweeney's belligerence is over the top, as if he already knows that in the end victory will be his and he's flaunting his position as he did in Friday's filing with the court. It's big media that should be asking U.S. Representative Cicilline what he promised Tim Sweeney before an official ruling on the matter has been made public.
Sweeney believes he's already the great Monopoly Killer and no one in their right mind would act out like Sweeney is doing without knowing ahead of time that Cicilline will hand him the final victory. Something really stinks here.
