International Classes

Apple filed their trademark specifically under International Classes 09, 41 and 42. Trademark classes are important because the trademark registration will only protect Apple's trademark(s) in the class that have been identified in their application.

Class 09

In Apple's U.S. trademark filing 88394250, Apple places emphasis on software for "class 9" as follows: "Application development software; computer software used in developing other software applications; computer operating system software; application programming interface software for use in developing applications for execution on graphic processor units"

In Apple's Hong Kong "M" (Metal) Logo filing 304905603, Apple places more and classic emphasis on all manner of hardware for Class 09. Below is an abbreviated list of the hardware listed in that filing:

"Computers; computer peripheral devices; computer hardware; computer gaming machines; hand held computers; tablet computers; personal digital assistants; electronic organizers; electronic notepads; electronic book readers; handheld electronic game units adapted for use with an external display screen or monitor; handheld digital electronic devices and software related thereto; handheld mobile digital electronic devices capable of providing access to the Internet and for the sending, receiving, and storing of telephone calls; televisions; television receivers; television monitors; set top boxes; computer software; computer and electronic games."

Class 41

"Providing education in the nature of tutorials in the field of computers, information technology, computer programming, computer software, computer games, and computer software and computer game development; providing electronic publications, and online library services, namely, manuals and handbooks in the field of computers, information technology, computer programming, computer software, computer games, and computer software and computer game development."

Class 42

"Computer programming; design and development of computer hardware and software; consulting services relating to the design, development, implementation, and use of computer hardware and software; consultation services related to the design and development of computer systems, databases and applications; providing information online relating to the design, development, implementation, and use of computer hardware and software; providing an online database featuring technical information regarding software development and programming."

Apple shows this Metal 2 page as their "Specimen" of use. The U.S. Patent Office defines a specimen as being an example of how a company is actually using their trademark in the marketplace with the goods or services in their application. It’s what consumers see when they are considering whether to purchase the goods or services Apple provides in connection with their trademark(s). In this case Apple has provided a specific website where the public and or developers can learn about "Metal 2."
