Yesterday three Class Actions were filed raising the total to thirty. Our report noted that there had been 8 filed from San Jose alone since December 22, and 13 in total from Northern California collectively. Today another two Class Actions were published by the court and both are from San Jose, raising their total to an even 10 and 15 collectively from Northern California.

Yesterday we learned that a prosecutor from France as launched a preliminary investigation into Apple's alleged planned product obsolescence. To top that off news broke later in the day that U.S. Senator John Thune (R., S.D.), chairman of the Senate Commerce Committee, sent a letter to Apple's CEO Tim Cook outlining several questions about how Apple came to the decision to slow down iPhones in conjunction with battery wear.

Earlier today, Apple's cheerleader Jim Cramer from CNBC said that Apple was unfairly become a target and punching bag of late.  

Causes for Action

The first Class Action lawsuit filed yesterday in San Jose was from John Ferguson, Kelli Beaugez and Gregory Stenstrom. The lawsuit listed six causes of action as noted below.

Count 4: BREACH OF CONTRACT

Count 5: BREACH OF IMPLIED DUTY TO PERFORM WITH REASONABLE CARE

Count 6: BREACH OF COVENANT OF GOOD FAITH AND FAIR DEALING

Count 7: QUASI-CONTRACT CLAIM FOR RESTITUTION
