A Colorado Company who Sued Netflix and others is now Targeting Apple's Streaming Products like Apple Music, iTunes & more

1 COVER APPLE SUED ON 6 COUNTS OF PATENT INFRINGEMENT 

 

A company by the name of Realtime Adaptive Streaming has filed a patent infringement lawsuit against Apple in the District Court of Colorado. The company had previously sued Cisco, Netflix and Hulu and yesterday the company filed a six count lawsuit against Apple.

 

The products that allegedly infringe on the company's patents are presented in the first two counts below. Those highlighted in blue in count 2 differ from those listed in count 1.

 

Count 1, patent 7,386,046: The following are the alleged infringing Apple products according to the lawsuit: Apple's streaming products/services (e.g., Apple's Internet Services), such as, e.g., iTunes Store, Apple Music, and devices with iOS 3.0 and later and computers with Safari 4.0 and later (e.g., iPhone, iPad, Apple TV, Mac, iPod, Apple Watch, etc.), and all versions and variations thereof

 

Count 2, patent 8,634,462: The following are the alleged infringing Apple products according to the lawsuit: Apple's products and services that implement the High Efficiency Video Coding (HEVC; also known as H.265) standard (e.g., iPhone, iPad, Apple TV, Mac, iPod, Apple Watch, iMovie, etc.), macOS High Sierra, iOS 11, QuickTime, and all versions and variations thereof.

 

The other counts against Apple include infringing these three patents: 8,929,442, 9,769,477, 9,578,298, and 8,934,535. The alleged infringing products are repetitive to those listed in the first two counts.

The patent infringement case presented in today's report was filed in the Colorado District Court, Denver Office. The Presiding Judge in this case is noted as being Judge Marcia S. Krieger and the Referring Judge is noted as Scott T. Varholak.

 

As a side note: One of the inventors listed on the one Realtime Adaptive Streaming patent 9,769,477 (listed above), James Fallon, is also listed as one of the inventors on patents 8,929,442 and 8,934,535 (listed above) associated with a related company called RealTime Data
