Class Action over Apple Store Employee Searches Dismissed

On July 16 we reported that a Federal Judge certified a class action against Apple that was filed by Apple retail store employees back in 2013. The report further noted that the Judge ordered documents to be unsealed on June 11 that revealed at least two Apple retail store workers having complained directly to CEO Tim Cook about their policy of checking retail employees' bags saying that the security precaution were embarrassing and demeaning.

 

Late yesterday BloombergBusiness reported that Apple persuaded a judge to throw out the lawsuit in California that was seeking back pay for time spent in "demoralizing" security searches.

 

District Judge William Alsup said in his ruling that "Workers were free to choose to avoid searches by not bringing bags with them. It is undisputed that some employees did not bring bags to work and thereby did not have to be searched when they left the store."

 

The U.S. Supreme Court ruled last year that workers don't have a federal right to be paid for time spent in post-shift security searches, unanimously rejecting claims by former Amazon.com Inc. warehouse workers. That decision left an opening for the Apple workers to pursue their case under California law.

 

The case could have cost Apple up towards $60 million plus penalties.The moral of the story is that if you`re a female employee bringing a purse to work like millions of women all over America every day, expect Apple to not trust you.
