Paul Allen's IP Firm Files new Lawsuit against Apple. Update: The Current Infringement Case was Dismissed

By now everyone knows that Paul Allen's IP firm "Interval Licensing" has sued most everyone in techland including Apple, AOL, eBay, Facebook, Google, Netflix, Yahoo and others. Today, Interval Licensing has filed a new patent infringement case against Apple in Seattle's District Court. Report Update 2:20 PM PT

 

The filing is so new that the court's public notice simply states that the proceedings for this case are not available at this time.

 

2. Internatl Licensing LLC v. Apple, Inc

 

The patents that were used in the past against Apple and others include the following:

 

US Patent 6,263,507 titled Browser for Use in Navigating a Body of Information, With Particular Application to Browsing Information Represented by Audiovisual Data; US Patent 6,034,652 titled Attention Manager for Occupying the Peripheral Attention of a Person in the Vicinity of a Display Device; And yet others include US Patent 6,788,314 and 6,757,682.

 

If the proceedings are made public later today we'll update our report accordingly.

From my understanding of the newly released court document, it would appear that the Judge has dismissed Interval Licensing case against all those in this suit including Apple. Though the Plaintiffs, including Apple, are free to continue with their countersuits against Interval Licensing if they so choose.

 

The document reads "Pursuant to each party's stipulation and based on the Court's claim construction order of December 28, 2012, the Court DIRECTS the clerk to enter a final judgemnt of invalidity of Claims 4-8, 11, 34 of the '652 Patent and Claims 1-4 and 7-15 of the '314 Patent and final judgement o non-infringement of Claims 15-18 of the '652 Patent. 

 

Having considered the parties' joint contingent stipulation of dismissal, the Court ORDERS the Defendants's counterclaims with respect to the '652 Patent and the '314 Patents are DISMISSED without prejudice and Defendants and each of them individually shall have the right to assert any and all defenses and counterclaims for infringement of the '652 Patent or '314 Patent in this or any future case."
