New Motorola Lawsuit Claims iPhone 4S & iCloud Infringe on their Patents

According to court documents, Motorola has launched their second patent infringement lawsuit against Apple in Miami, Florida. In Motorola's new complaint they claim that Apple is infringing on six additional patents ranging from concealing an external antenna on a cell phone on through to a wireless messaging system. Motorola is mainly focusing on Apple's iPhone 4S smartphone and iCloud services as being the product and service infringing on their patents. It's safe to say that Google has given Motorola the green light and their blessing to proceed with this case.    

 

The Alleged Patent Infringement In-Part

 

Court documents reveal today that Motorola has launched a second lawsuit against Apple in the state of Florida, alleging that Apple has infringed on six additional patents.

 

The official complaint states that "Motorola Mobility brings this action against Apple to seek remedies for Apple's infringement of U.S. Patents 5,710,987 ("the '987 patent"), 5,574,119 ("the '119 patent"), 5,958,006 ("the '006 patent"), 6,101,531 ("the '531 patent"), 6,008,737 ("the '737 patent"), and 6,377,161 ("the '161 patent") (together, "the Asserted Patents")."

 

The Six Counts against Apple

 

The First Count against Apple relates to patent 5,710,987 entitled "Receiver Having Concealed External Antenna," lawfully issued on January 20, 1998. Motorola points to the iPhone 4S as the main product that is allegedly infringing upon their patent.

The Second Count against Apple relates to patent 5,574,119 entitled "Multiple Pager Status Synchronization System and Method," lawfully issued on May 19, 1998. Motorola points to the iPhone 4S and iCloud as the main product and service that are allegedly infringing upon their patent. There appears to be an error in Motorola's complaint on this count's information. They list patent 5,574,119 which isn't a Motorola patent as we point out in our graphic below.

The Third Count against Apple relates to patent 5,958,006, entitled "Method and Apparatus for Communicating Summarized Data," lawfully issued on September 28, 1999. Motorola points to the iPhone 4S and iCloud as the main product and service that are allegedly infringing upon their patent.

The Fourth Count against Apple relates to patent 6,101,531, entitled "System for Communicating User-Selected Criteria Filter Prepared at Wireless Client to Communication Server for Filtering Data Transferred from host to Said Wireless Client," lawfully issued on August 8, 2000. Motorola points to the iPhone 4S and iCloud as the main product and service that are allegedly infringing upon their patent.

The Fifth Count against Apple relates to patent 6,008,737, entitled "Apparatus for Controlling Utilization of Software Added to a Portable Communication Device," lawfully issued on December 28, 1999. Motorola points to the iPhone 4S as the main product that is allegedly infringing upon their patent.

The Sixth and Final Count against Apple relates to patent 6,377,161, entitled "Method and Apparatus in a Wireless Messaging System for Facilitating an Exchange of Address Information," lawfully issued on April 23, 2002. Motorola points to the iPhone 4S and iCloud as the main product and service that are allegedly infringing upon their patent.

Motorola is seeking adequate compensation for Apple's infringement of the asserted patents and is seeking triple damages for Apple's willful and deliberate infringement of each patent presented in this complaint.  

 

The case was filed in the United States District Court for the Southern District of Florida, Miami Office. The Judge assigned to the case is Judge William J. Zloch,  Referred to: Magistrate Judge Robin S. Rosenbaum. Motorola's first case that's on ongoing in Florida is noted as bieng case 1:10-CV-23580-RNS.
