Apple's 'Genius' Logo Trademark Now Covers Games, Books and More

GENIUS BAR LOGO TRADEMARK 2009

The US Patent & Trademark Office has recently published Apple's latest trademark application 77688997 covering Apple's Genius logo. The application updates Apple's 2007 application which covered International classes for retail store services, maintenance and support. The updated application has added International Classes 9 and 41 which basically cover Apple's use of Genius Playlists and Genius Sidebar in iTunes. While these iTune services are restricted to music today, the updated application suggests that the services will extend to other content such as television shows, movies, games books and more in the future.  Apple's claim of priority is based on their Trinidad and Tobago application 40266 filed in late 2008.

International Class 009: Computer software for use in authoring, downloading, transmitting, receiving, editing, extracting, encoding, decoding, playing, storing and organizing audio, video, graphics, text and data; software for providing customized recommendations based on user preferences; electronic publications in the field of music, concerts, videos, movies, radio, television, books, news, sports, games, cultural events and arts and leisure.

 

International Class 035:  Retail store services in the field of entertainment, audio, audiovisual, music, multimedia and video content and related merchandise, provided via the internet and other computer and electronic communication networks; compilations of directories for publishing on the internet; promoting the goods and services of others over the internet.

 

International Class 041:  Providing databases and directories in the field of music, concerts, videos, movies, radio, television, books, news, sports, games, cultural events and arts and leisure via communications networks; providing prerecorded audio, video and entertainment content according to user preferences via communications networks; providing prerecorded audio, video and entertainment content, information, graphics, text, online publications and other multimedia content in the field of music, concerts, videos, movies, radio, television, books, news, sports, games, cultural events and arts and leisure via communications networks.

 

About the Logo: The application states that "the colors purple and gray are claimed as a feature of the mark. The mark consists of a stylized atomic model design." For the record, Apple's black and white version of the Genius logo was also updated earlier this month under 77688993. The update includes the same International Classes noted above.

 

Apple's actual Genius trademark was itself updated this past January under application 77650466. The update covered International Classes 9 and 41.
